The Oregon Department of Agriculture issued 16 civil penalties in 2011 in the amount of $17,336 for violations related to confined animal feeding operations (CAFOs). The violations generally involve problems with animal waste management leading to water pollution and/or failure to submit an annual report as required by law.
The CAFO civil penalties include the following:
- April 20, 2011, Eric Silva and Paula Wolf of Sunset Canyon Jerseys were issued a $2,376 civil penalty for their Tillamook County dairy located on Blankenship Road, for failing to observe all winter setback requirements and land applying liquid manure that, due to equipment failure, resulted in run off into waters of the state.
- April 20, 2011, Seth Spencer was issued an $800 civil penalty for his Linn County dairy located on Green Mountain Drive, for failure to submit the 2010 annual report.
- April 20, 2011, Michael Moss of Siskiyou Crest Goat Dairy was issued a $720 civil penalty for his Jackson County dairy located on Sterling Creek Road, for failure to submit the 2010 annual report.
- April 20, 2011, Cris Rocha of Rocha Jersey was issued a $720 civil penalty for his Tillamook County Dairy located on Highway 101, for failure to submit the 2010 annual report.
- April 20, 2011, Edwina Price of Price Dairy, LLC. was issued a $680 civil penalty for her Tillamook County dairy located on Highway 101, for failure to submit the 2010 annual report.
- April 20, 2011, Ben Parker of Marks & Parker Dairy was issued a $680 civil penalty for his Clatsop County dairy located on Leino Lane, for failure to submit the 2010 annual report.
- April 20, 2011, Paul Obringer was issued a $720 civil penalty for his Linn County goat farm located on Highway 226, for failure to submit the 2010 annual report.
- April 20, 2011, Marcia Shannon of Mrs. O'Poodles was issued a $680 civil penalty for her Josephine County dog kennel located on Ewe Creek Road, for failure to submit the 2010 annual report.
- April 20, 2011, Mark Malott of Malott Livestock was issued an $680 civil penalty for his Crook County cattle feedlot located on SW Parrish Lane, for failure to submit the 2010 annual report.
- April 20, 2011, Randy Guerin of Guerin Dairy was issued a $680 civil penalty for his Curry County dairy located on Allen Boice Drive, for failure to submit the 2010 annual report.
- April 20, 2011, Steve Gage of Frogsong Farm was issued an $800 civil penalty for his Coos County dog kennel located on N. Bank Lane, for failure to submit the 2010 annual report.
- April 20, 2011, Gary Duyck of Duyck's Peachy Pig was issued a $720 civil penalty for his Washington County hog and pig farm located on SW Johnson School Road, for failure to submit the 2010 annual report.
- April 20, 2011, J. Mike Bridgewater of Bridgewater Dairy was issued an $800 civil penalty for his Malheur County dairy located on HWY 201, for failure to submit the 2010 annual report.
- July 22, 2011, John W. Pugh, Jr. of Pugh Century Dairy was issued a $1,680 civil penalty for his Linn County dairy located on Highway 99 E, for failure to keep record and failure to properly operate and maintain portions of the facility.
- July 22, 2011, Larry and Roseanne Rogers of Mira Farms was issued a $4,560 civil penalty for their Josephine County horse facility located on Missouri Flat Road, for a discharge to waters of the state.
- July 22, 2011, Chad Martin of Martin Calf Facility was issued a $280 civil penalty for his Tillamook County calf facility located on South Prairie Road, for placing wastes where they were likely to enter waters of the state.
Individuals receiving civil penalties from the Oregon Department of Agriculture can contest the notice through an administrative hearing.
