Introduction
On October 1, 2009, the Land Conservation and Development Commission (LCDC) directed the Department of Land Conservation and Development (DLCD) to initiate an administrative rulemaking project for the Religious Land Use and Institutionalized Persons Act (RLUIPA).
 
This action addresses a recent decision by the Oregon Land Use Board of Appeals (LUBA) that determined the commission’s rule that prohibits churches in exclusive farm use (EFU) zones, which are also within three miles of an urban growth boundary (UGB), was invalid as applied to a particular development proposal in Jackson County because it violated the “equal terms” provision of RLUIPA.
 
The LUBA opinion states that the rule treats churches on less than equal terms with other, secular, places of assembly. The department believes that the rule should be revised to be consistent with the opinion.

At the same October 1 meeting, LCDC appointed an advisory committee to advise the department and the commission (see below). Based on input and recommendations from the committee, LCDC anticipates adopting new or amended administrative rules in the spring of 2010.

After nearly seven months of work and three meetings of an advisory committee, DLCD will bring proposed amendments of Oregon Administrative Rules 660-033-0120 and 0130 to the June 2-4 LCDC meeting in John Day.
